Your options may include:

  • Chapter 7 Bankruptcy will eliminate your unsecured debts, like credit card debts, medical bills, and past-due payments on your mortgage or car loan. In most cases, you're able to keep what you own, including the things you'll need to move ahead – your house, car, clothes, household items, and retirement accounts. The process is not as scary as you imagine. One of our bankruptcy lawyers will meet with you, and once we have your okay, we'll file your petition. Approximately four weeks later, you'll take part in a short meeting, where you'll be asked some simple questions about your finances. Approximately two months later, the Court should issue a discharge order that will eliminate qualified debts.
  • Chapter 13 Bankruptcy will create a three- or five-year payment plan to repay your debts and offers an alternative for people with steady income who do not meet the qualifications for Chapter 7 bankruptcy. Chapter 13 bankruptcy is also an alternative for people who have fallen behind in income tax or child support payments.
  • Settlement agreements – Bankruptcy may not be your best option. If that is the case, we can negotiate a settlement agreement with your creditors to reduce the amount you owe, and give you a structured repayment plan. Beware of debt consolidation companies, who will offer you something that sounds similar, but charge you high upfront administrative fees – often equal to 15 percent of what you owe, and will require you to cancel your credit cards and make payments to an escrow account they hold. You may be making payments in good-faith, but your creditors have not agreed to a settlement.
