Pedestrian accident in CVS parking lot kills Rhode Island woman

Virtually everyone in Rhode Island has experienced the need to stop short in a parking lot because some obstacle suddenly appears behind the vehicle. Most of the time, there is no collision. However, periodically, a car or pedestrian accident occurs in a busy parking lot.

For example, a motorist was recently driving through a CVS parking lot. At the same time, a pedestrian was walking through the parking lot. The vehicle accidentally struck the 78-year-old woman. When she fell, she hit her head on the asphalt and suffered a head injury.

Emergency personnel transported the elderly woman to Rhode Island Hospital. Despite the efforts of doctors and other hospital staff, the woman succumbed to her head injury later that same night. The medical examiner confirmed that her death was caused by the head injury she received in the accident.

Since the woman died due to what has been characterized as a "low speed" collision, information regarding the accident will be taken to the attorney general's office. There, it will be determined whether this will become a criminal matter. The investigation is not yet concluded, but it is not believed that charges will be filed against the driver.

A lack of criminal charges does not preclude the family of the elderly woman from filing a wrongful death claim, however. If it is documented to the court's satisfaction that the driver's actions negligently contributed to or caused the victim's death, the family could receive an award of damages. Those damages help the family recover financial losses typically associated with a deadly pedestrian accident.
